The Local Jurisdiction of Notaries, or the territorial limits within which they can exercise their duties, is regulated by Article 4 of Law 2830/2000 “Code of Notaries”, which, as amended, is currently in force and states verbatim as follows:
“Article 4 – Local Jurisdiction
The notary exercises his duties throughout the entire district of the Peace Court to which he is appointed, as the district of the Peace Court is defined from time to time. The conduct of compulsory or voluntary auction is excluded, which is conducted at the premises of the locally competent Peace Court.
By way of exception to the provisions of the preceding paragraphs, the notaries who are appointed in the municipalities that fall judicially within the districts of the following Peace Courts: a) Athens, b) Piraeus, c) Nicaea, d) Kallithea, e) Nea Ionia, f) Peristeri, g) Chalandri, h) Amarousio, i) Salamis, j) Acharnae, k) Kropia, l) Eleusina, m) Megara, n) Marathon, o) Lavrio, except for the island of Kea, p) Nea Liosia and q) Agia Paraskevi have the right to exercise their duties in the other districts of the above Peace Courts, but only if they are called upon to sign the notarial acts at the home, business or office of one of the contracting parties or their representatives or at the place of hospitalization, if hospitalized, or detention, if detained, or at the premises of a bank or other financial institution or organization, as well as when they cooperate with another notary or they are entrusted with the conduct of an auction.
The notary has the right and the obligation to maintain only one office at the seat where he is appointed. The violation of this obligation constitutes a disciplinary offense.”
Therefore, based on the above article of the Code of Notaries and in view of the fact that I am an appointed Notary in the district of the Komotini Peace Court (Appointment Gazette: Gazette 58/23-1-2009 issue Γ):
I have local jurisdiction to sign notarial acts:
Throughout the entire district of the Komotini Peace Court but only in these districts, under the condition that: I am called upon to sign the notarial acts:
at the home or business or office of one of the contracting parties or their representatives
or at the place of hospitalization, if hospitalized, or detention, if detained, or at the premises of a bank or other financial institution or organization, or when I cooperate with another notary or I am entrusted with the conduct of an auction.
NOTE: The above conditions and restrictions refer exclusively to the place of signing of the Notarial Acts. There is often a misunderstanding that Notaries can only draw up contracts for properties located within the area of their local jurisdiction, which is certainly not true. A Notary, regardless of the peace court district in which he is appointed, can draw up and sign contracts for properties located anywhere in Greece. Local jurisdiction, as mentioned above, concerns exclusively and only the place of signature and not the subject matter of the contract.
